Curb Records, Inc. takes privacy seriously. This Privacy Policy explains how Curb Records, Inc. and the affiliated entities thereof (collectively, “Curb,” “we,” “our,” or “us”) collect, use, disclose, retain, sell, share, and otherwise process information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual or household (“Personal Information”). Personal Information may include identifiers and contact details; account and transaction information; payment-related information; commercial and listening information; internet, device and network activity; geolocation; audio, visual and similar information; preferences, interests and inferences; marketing and communications information; and other information described in this Privacy Policy or provided at or before collection.

This Privacy Policy describes our practices in connection with Personal Information that we collect from you in person and through certain of our owned or controlled websites, online stores, web properties (e.g., widgets and applications) and mobile applications (“Mobile Apps”) in each case, that link to this Privacy Policy (each, a “Platform” or collectively our “Platforms”).

This Privacy Policy applies to Curb as a whole and where there are local variations or additions concerning how we use your Personal Information collected from your home country, these are set out clearly in the Country Specific Schedules section of this Privacy Policy. Please treat these schedules as a part of this Privacy Policy. If you are a California resident, please note that we have a separate California Privacy Policy which applies to the collection and use of your Personal Information along with this Privacy Policy and also addresses your privacy rights. Please note that our Platforms are not directed to individuals under the age of sixteen (16), and we request that such individuals do not provide Personal Information through the Platforms.

HOW WE USE YOUR PERSONAL INFORMATION

We receive Personal Information about you, either directly from you, from a third-party source (a source other than you, for example, when you make an album purchase on Ticketmaster) or by automated collection when you use any of our Platforms.

We use and otherwise process Personal Information for the purposes described in this Privacy Policy and, where applicable, for other purposes disclosed at or before the time of collection that are compatible with the context in which the information was collected. Depending on the jurisdiction and activity, our lawful basis may include performance of a contract or steps requested before entering a contract; compliance with law; consent; our legitimate interests or those of a third party; or another basis permitted by applicable law. Where consent is not legally required, we may rely on another available lawful basis. Where we rely on legitimate interests, those interests may include operating, protecting, developing, analyzing, promoting and expanding our business, artists, labels, brands, Platforms, content, products, services and commercial relationships.

The tables below provide examples of how we collect and use Personal Information and the lawful bases that may apply. These examples are not intended to limit us from processing Personal Information for any additional disclosed purpose that is reasonably necessary and proportionate, compatible with the context of collection, or otherwise permitted by applicable law. Where a jurisdiction requires consent for a particular activity, we will obtain consent before engaging in that activity and will honor legally required withdrawal, opt-out, or limitation rights.

Please bear in mind that if you choose not to provide information requested by us, or if you object to our use of your Personal Information where we have made it clear that this information is mandatory, we may not be able to provide you with the services you have requested or otherwise fulfil the purpose(s) for which we have asked for your Personal Information.

Social Media Audience Advertising You give us Personal Information about you when you sign up or agree to receive marketing communications from us including social media advertising. This is generally information including your name, email address, social media username or handle, telephone number and marketing preferences. Where we have a social media pixel on any of our Platforms, you give us Personal Information about you when you consent to this pixel interacting with and collecting data from your device when you access our Platforms. This is generally information on the fact that you have visited our Platforms and have an account on our partner social media platforms (e.g. Facebook or Google).	With your consent To send you our custom adverts on your social media account using audience targeting technology, where our social media partners match your email address or information collected from our social media pixels with your user account on their platform (if you have one), and include you on a group of individuals to whom we can send custom adverts. This “Custom Audience” group is created and stored only on your social media platform and although we can send custom adverts to you, we can’t tell if you have been included on the Custom Audience group and do not have access to any information held on your social media account. To segment you for the purposes of determining what content is best suited to send to you and what custom audience group you are best suited to. We do this, for example, by analyzing factors about you such as how you have signed up to receive marketing communications from us (e.g. on our website or through a competition), your location, the marketing preferences you have communicated to us (e.g. the Artist you have said you are interested in) and even by analyzing your interactions with our Platforms and your listening behavior where you have given us consent to do so (see “Listening Behavior on Streaming Platforms” section below). To create a separate group of social media users with similar characteristics as those who have been included on our Custom Audience groups. This “Lookalike Audience” group is created and stored only on the platforms of our social media partners. Although we can send custom adverts to individuals on this Lookalike Audience group, we can’t identify any individuals included in this group and do not have access to any information held by the social media platform on these individuals.

Listening Behavior on Streaming Platforms If you give us permission to, we collect Personal Information from streaming platforms you use (e.g. Spotify) on your listening behavior on their platform. This includes information on tracks, playlists and albums listened to, along with your top genres and artists.	With your consent To analyze your listening behavior (on both an aggregated and personally identifiable bases) for the purposes of determining what marketing content may be more suitable to send to you, if you have consented (on the streaming platform) to receiving direct marketing communications from us and in line with your marketing preferences. For example, if we identify one artist as a top artist based on your listening behavior, we may recommend a similar artist who we think you may like but you haven’t yet listened to. Please note that you can withdraw your consent to us using your listening behavior through your streaming platform or by contacting us at [email protected] (with a copy to [email protected]) To monitor the performance of our content on streaming platforms by analyzing users’ listening behavior.
Pre-save/Pre-add If you pre-save or pre-add any of our unreleased content on a streaming platform, the streaming platform may share your Personal Information with us. This may include information on the pre-save/pre-added content you have selected, along with your name, email address, city, country and (if applicable) your marketing preferences where you have opted into receiving marketing communications from us.	With your consent To add requested content to your streaming platform library when this content is officially released and to send you an email informing you of the official release of such content. To send you marketing communications by email where you have agreed to receive these communications. Listening Behavior on Streaming Platforms

If you give us permission to, we collect Personal Information from streaming platforms you use (e.g. Spotify) on your listening behavior on their platform. This includes information on tracks, playlists and albums listened to, along with your top genres and artists.

With your consent

To analyze your listening behavior (on both an aggregated and personally identifiable bases) for the purposes of determining what marketing content may be more suitable to send to you, if you have consented (on the streaming platform) to receiving direct marketing communications from us and in line with your marketing preferences. For example, if we identify one artist as a top artist based on your listening behavior, we may recommend a similar artist who we think you may like but you haven’t yet listened to. Please note that you can withdraw your consent to us using your listening behavior through your streaming platform or by contacting us at [email protected] (with a copy to [email protected])

To monitor the performance of our content on streaming platforms by analyzing users’ listening behavior.

Pre-save/Pre-add

If you pre-save or pre-add any of our unreleased content on a streaming platform, the streaming platform may share your Personal Information with us. This may include information on the pre-save/pre-added content you have selected, along with your name, email address, city, country and (if applicable) your marketing preferences where you have opted into receiving marketing communications from us.

Under the CCPA, “sale” and “sharing” are defined broadly and may include certain disclosures or making available of Personal Information for monetary or other valuable consideration or for cross-context behavioral advertising. During the preceding twelve (12) months, we may have disclosed the categories of Personal Information described above for business purposes to the categories of recipients described in this Privacy Policy, and we may have sold or shared identifiers, customer-record information, protected-classification characteristics, commercial information, internet or network activity, geolocation information, and inferences with advertising, social media, measurement, marketing or data partners, depending on the technologies and campaigns used. We do not sell or share Personal Information when an exception under the CCPA applies.

We do not knowingly sell or share the Personal Information of consumers under 16 years of age without the affirmative authorization required by the CCPA.

10.5 Your California Privacy Rights

Requests to Know/Access, Correct and Delete

Subject to applicable exceptions and verification requirements, you may request that we disclose the categories and specific pieces of Personal Information we have collected about you, the categories of sources, our business or commercial purposes, the categories of third parties to whom we disclose Personal Information, and information regarding our sale or sharing of Personal Information. You may also request correction of inaccurate Personal Information and deletion of Personal Information, subject to exceptions provided by law.

You may also request a portable copy of Personal Information to the extent required by the CCPA.

We will verify and respond to your request consistent with applicable law, taking into account the type, sensitivity and risk of the Personal Information involved. We may request information reasonably necessary to verify your identity or authority, but we will not require more information than reasonably necessary for verification.

Authorized Agents

You may use an authorized agent to submit a request where permitted by the CCPA. We may require proof that you gave the agent signed permission to submit the request and may verify your identity or confirm directly with you that you provided the agent permission, unless an applicable power of attorney or other legal exception applies.

Requests to Opt Out of Sale or Sharing / Targeted Advertising

You have the right to direct us not to sell or share your Personal Information. Where required, you may exercise this right through the “Your Privacy Choices” / “Do Not Sell or Share My Personal Information” if this mechanism is made available on the relevant Platform. We also process legally recognized opt-out preference signals, including Global Privacy Control, as required by applicable law. We do not require you to create an account to exercise an opt-out right.

Requests to Limit Use and Disclosure of Sensitive Personal Information

If we use or disclose Sensitive Personal Information for purposes that trigger the CCPA’s right to limit, you may direct us to limit such use or disclosure through the “Limit the Use of My Sensitive Personal Information” or combined “Your Privacy Choices” mechanism made available on the relevant Platform. This right does not apply to uses or disclosures for which the CCPA provides an exception.

Right to Non-Discrimination / No Retaliation

You have the right not to receive discriminatory treatment prohibited by the CCPA for exercising your CCPA rights.

Do Not Track and Opt-Out Preference Signals

Some browsers offer “Do Not Track” signals, for which there is no uniform industry standard. Separately, as described above, we honor qualifying opt-out preference signals, including Global Privacy Control, where required by applicable law.

California “Shine the Light” Rights

California Civil Code section 1798.83 may permit California residents to request certain information regarding disclosure of Personal Information to third parties for their own direct marketing purposes.
